Re-Entry Permit Granted to Individual Older than 79 Without Biometrics

Getson & Schatz P.C were successful in obtaining a reentry permit for a client filing Form I-131 Application for Reentry Permit. A Reentry Permit allows a permanent resident or conditional resident to apply for admission to the United States upon returning from abroad during the permits validity without the need to obtain a returning resident visa from a U.S. Embassy or consulate. If you are in the United States as a permanent resident or conditional permanent resident you should apply for a Reentry Permit if you plan to be absent from the US for more than 6 consecutive months.

You must be physically present in the United States when you file the Reentry Permit application and must complete the biometrics services requirement within 120 days of filing. You can either file, provide your biometrics and then leave the US or you can file, leave the US, and return within 120 days to be fingerprinted. After fling the application, USCIS will inform you when to go to your local Application Support Center (ASC) for your biometrics services appointment. If you are between the ages of 14 through 79 and applying for a Reentry Permit you must also be finger printed as part of USCIS biometrics services requirement; failure to appear to be fingerprinted or for other biometrics services may result in a denial of your application. Per the NSC Liaison Practice Statement on Reentry Permits, NSC will issue a Reentry permit without requiring an applicant to attend a biometrics appointment when applicant is below the age of 14 or over the age of 79 and submits two passport style photographs in addition to all other required documents for the I-131.

In this case, the applicant was 83 years old and therefore not required to appear for a Biometrics appointment. Our attorneys enclosed two passport style photographs of the applicant in lieu of scheduling a biometrics appointment and the USCIS granted the applicant a Reentry Permit, giving him admission to the United States upon returning from abroad.
