H-1B Petition approved for Counselor who did not Require State License to Practice

Our firm was retained to represent a major medical center that wished to sponsor an individual in H-1B status for the position of Crisis Counselor. The position did not require a state license but in positions involving health care, USCIS generally requests a copy of the state license authorizing the individual to hold the position or a letter from the State Licensing Agency indicating that a license is not required to work in the profession. Rather than wait for a possible Request for Evidence from Immigration regarding the licensure issue, our lawyers had our client obtain a letter from the state that a license is not required for the position and the H-1B Petition was approved.
